Is spitting at someone assault or battery?

Spitting at someone may not be a violent act, or one that could cause a person any damage, which may lead you to believe it could not be punished by law like one.
While you could now be slapped with a tax if you’re caught spitting chewing gum out in the street, spitting itself is not generally thought of as an act of violence, despite it being a repulsive one.
But does it count as assault or battery during a confrontation?
