Theresa May doesn’t have the legal power to trigger the Brexit process by herself, the High Court has heard.
The Prime Minister has been accused of attempting to start our process of leaving the EU by unlawfully using ancient executive powers under the royal prerogative.
In one of the most important constitutional cases in generations, Lord Pannick QC argued that May had no legal power to trigger Article 50 of the Lisbon Treaty – which would start the leave process – without the prior authorisation of Parliament.
